Article 1

Area of ​​application

2. This Directive shall not apply to:
a) pipelines consisting of a pipeline or system of pipelines intended for the conveyance of any
fluid or substance to or from an installation (land or sea) from the last device
Insulation located around the perimeter of the installation, including said device and all associated equipment specifically designed for the pipeline. This exclusion does not cover standard pressure equipment such as that found in decompression stations or compressor stations;
b) the networks intended for the supply, distribution and evacuation of water, as well as their equipment and pipelines.
motive water, such as penstocks, pressure tunnels or loading galleries, for hydroelectric installations and their
specific accessories;
(c) simple pressure vessels regulated by Directive 2014/29/EU of the European Parliament and of the Council (1);
(d) aerosol generators regulated by Council Directive 75/324/EEC (2);
e) equipment intended for the operation of vehicles defined in the following legal acts:
(i) Directive 2007/46/EC of the European Parliament and of the Council (3)
ii) Regulation (EU) No 167/2013 of the European Parliament and of the Council (1),
iii) Regulation (EU) No 168/2013 of the European Parliament and of the Council (2);
f) teams classified at most in category I in accordance with the provisions of Article 13 of this Regulation.
Directive and which are covered by one of the following Directives:
(i) Directive 2006/42/EC of the European Parliament and of the Council (3),
ii) Directive 2014/33/EU of the European Parliament and of the Council (4),
iii) Directive 2014/35/EU of the European Parliament and of the Council (5),
iv) Council Directive 93/42/EEC (6),
(v) Directive 2009/142/EC of the European Parliament and of the Council (7),
(vi) Directive 2014/34/EU of the European Parliament and of the Council (8);
(g) the equipment referred to in Article 346(1)(b) TFEU;
h) equipment specifically designed for nuclear use, the failure of which could cause radioactive emissions;
(i) well control equipment used in the oil, gas or geothermal exploration and extraction industry, as well as for underground storage, designed to contain or control well pressure.
Such equipment will include the wellhead (Christmas tree), blowout preventers (BOP), pipes and manifolds, as well as their auxiliary equipment beforehand;
j) equipment containing covers or mechanisms whose dimensions, selection of materials and manufacturing standards are based primarily on criteria of strength, rigidity and stability sufficient to withstand the static and dynamic effects of operation or other characteristics related to its operation and for which the
pressure does not constitute a significant design factor. Such equipment may include:
(i) engines, including turbines and internal combustion engines,
ii) steam engines, gas and steam turbines, turbogenerators, compressors, pumps and drive devices;
k) blast furnaces, with their cooling systems, their hot air recuperators, their dust extractors and their
blast furnace exhaust gas scrubbers, and direct reduction cupolas, with their cooling systems,
its gas converters and its melting, remelting, degassing and moulding vats for steel, iron and
non-ferrous metals;
l) covers of high voltage electrical equipment, such as connectors and controls, transformers and
rotary machines;
(m) pressurized casings surrounding transmission systems, such as electric cables and telephone cables;
n) ships, rockets, aircraft or mobile coastal units, as well as equipment specifically intended to be
installed on board or to propel them;
(o) pressure equipment consisting of a flexible cover, such as, for example, tyres, air cushions, play balls, inflatable boats and other similar pressure equipment;
p) exhaust and intake silencers;
q) metal bottles or cans for carbonated beverages intended for final consumption;
r) containers intended for the transport and distribution of beverages whose PS·V product does not exceed 500 bar per
litre and whose maximum permissible pressure does not exceed 7 bar;
s) equipment regulated by Directives 2008/68/EC and 2010/35/EU and equipment regulated by the Maritime Code
International Dangerous Goods Convention and the Convention on International Civil Aviation;
t) radiators and pipes in hot water heating systems;
(u) containers intended to contain liquids whose gas pressure above the liquid does not exceed 0,5 bar
