Area of ​​application


1. This Directive shall apply, without prejudice to paragraph 2, to EEE belonging to the categories set out in Annex I.


2. Without prejudice to Article 4(3) and (4), Member States shall provide that EEE which were outside the scope of Directive 2002/95/EC, but which are not found to be in compliance with this Directive, may nevertheless continue to be placed on the market until 22 July 2019.
3. This Directive shall apply without prejudice to the requirements of Union legislation on safety and
hygiene and chemicals, in particular Regulation (EC) No 1907/2006, as well as the requirements of specific Union legislation on waste management

Area of ​​application


4. This Directive shall not apply to:
(a) the equipment necessary for the protection of the essential security interests of Member States, including arms, ammunition and war material intended for specifically military purposes;
b) devices intended to be sent into space;
(c) specifically designed appliances which must be installed as part of other types of appliances which are not included in or do not fall within the scope of this Directive, which can fulfil their function only as part of such appliances and which can only be replaced by the same specifically designed appliances;
d) large fixed industrial tools;
e) large-scale fixed installations;
f) means of transporting people or goods, excluding two-wheeled electric vehicles that are not approved;
g) non-road mobile machinery provided exclusively for professional use;
h) active implantable medical devices;
(i) photovoltaic panels intended to be used in a system designed, assembled and installed by professionals
for permanent use at a defined location, intended for the production of solar energy for public, commercial, industrial and residential applications;
j) equipment specifically and exclusively designed for research and development purposes, made available only in an intercompany context
