Scope of application
Area of application
1. This Directive shall apply to products designed or intended, whether or not exclusively, for use by children under the age of XNUMX for play purposes (hereinafter referred to as "toys").
Exceptions
Area of application
The products listed in Annex I shall not be considered toys for the purposes of this Directive.
2. This Directive shall not apply to the following toys:
a) playing field equipment intended for public use;
b) automatic gaming machines, whether or not coin-operated, intended for public use;
c) toy vehicles equipped with combustion engines;
d) toy steam engines; and
e) slings and slingshots.
ANNEX I
List of products which, in particular, are not considered toys within the meaning of this Directive
(referred to in Article 2, paragraph 1)
1. Decorative objects for festive events and celebrations.
2. Products for adult collectors, provided that the products or their packaging bear a visible and
legible that they are intended for collectors no younger than fourteen years of age. Examples of this category:
a) detailed and faithful scale models,
b) assembly kits of the detailed scale models,
c) folk and decorative dolls and other similar articles,
d) historical reproductions of toys, and
e) reproductions of real firearms.
3. Sports equipment, including roller skates, inline skates, and skateboards intended for children with
a body mass greater than 20 kg.
4. Bicycles with a maximum saddle height greater than 435 mm, measured as the vertical distance between the ground and the
highest point of the saddle surface, with the saddle positioned horizontally and the seat post at the lower mark.
5. Scooters and other means of transport designed for sport or intended for use on public roads or paths
public.
6. Electric vehicles intended for use on public roads, public paths or sidewalks.
7. Aquatic equipment intended for use in deep water and accessories for learning to swim for children, such as seat floats and swimming aids.
8. Puzzle of more than 500 pieces.
9. Compressed gas weapons and pistols, except water weapons and pistols, and archery bows over 120 cm long.
10. Fireworks, including percussion caps not specifically designed for toys.
11. Products and games that use pointed projectiles, such as metal-tipped dart sets.
12. Functional educational products, such as electric ovens, irons or other functional products whose voltage
exceed 24 volts sold exclusively for educational purposes under adult supervision.
13. Products intended to be used for educational purposes, such as scientific equipment, in schools and other contexts
educational under the supervision of adult instructors.
14. Electronic equipment, such as personal computers and game consoles, used to access interactive software and
its associated peripherals, if the electronic equipment or associated peripherals are not designed and intended
specifically for children and have a playful value in themselves, such as specially designed personal computers,
keyboards, joysticks or steering wheels.
15. Interactive software intended for leisure and entertainment, such as computer games and their supporting media
storage, for example, CDs.
16. Pacifiers for babies.
17. Attractive lamps for children.
18. Electrical transformers for toys.
19. Fashion accessories for children that are not intended for play
